Introduction, acceptance and definitions
These Terms of Use govern access to and use of TravelDesk, its web platforms, operational integrations and the TravelDesk Connect mobile application, collectively the Service.
By creating an account, signing in, using the platform, entering information, uploading documents, viewing reservations, managing commissions or connecting services related to payments or payouts, the user accepts these Terms of Use.
TravelDesk Connect is intended for commercial partners, commission agents, authorized collaborators, administrators and connected companies. It is not intended for minors or child consumers.
For the purposes of these terms, User means the authorized person who accesses the Service; Connected Company means the company, agency, operator or entity that uses TravelDesk to operate services; Partner or Commission Agent means the user authorized to generate, view or track commercial activity, reservations, commissions or payouts.
Scope of the service
TravelDesk provides tools for tourism operations, reservation management, connected companies, authorized users, reports, commissions, documentation, operational notifications and integrations necessary to provide the service.
TravelDesk Connect allows authorized partners, commission agents and administrators to register profiles, validate information, upload documents, view commercial activity, track reservations or commissions, receive operational notifications and access workflows related to Stripe Connect where applicable.
The Service may be available only to users who have been previously authorized, approved or associated with a connected company. TravelDesk may review, approve, reject, suspend or limit registrations when necessary to protect security, prevent fraud, validate identity, comply with legal obligations or maintain the proper operation of the Service.
TravelDesk does not guarantee that all users will have access to all features. Available features may depend on role, company, country, permissions, internal approval, documentation submitted, technical availability or compliance with third-party requirements.
Accounts, eligibility and authorized use
The user must provide truthful, complete, up-to-date and verifiable information. The user is responsible for maintaining the confidentiality of their credentials, devices, sessions and any authorized access to their account.
The user agrees not to share access with unauthorized persons, impersonate others, enter false information, upload altered documents, manipulate commissions or reservations, attempt to access data belonging to other companies or users, or use the Service for illegal, fraudulent, abusive purposes or purposes contrary to these terms.
TravelDesk may request additional information to validate identity, commercial relationships, permissions, tax documents, identification documents, eligibility for commissions or access authorization. Missing information, inconsistent information or documents that cannot be validated may result in rejection, limitation or suspension of features.
Connected companies are responsible for managing their users, internal permissions, operational data, customer data, commercial rules, commissions, services offered and compliance with their obligations to their own customers, collaborators or partners.
Payments, commissions, payouts and Stripe Connect
TravelDesk may use Stripe, Stripe Connect or other authorized providers to process payments, onboarding, validation, account statuses, payouts or commission payments, as appropriate to the operation of the Service.
In TravelDesk Connect, Stripe Connect is used for payouts, commission payments, validation of eligible accounts or management of statuses related to payments to partners or commission agents. This use does not constitute the sale of digital goods within the app, does not unlock digital consumer content and does not represent an in-app subscription within the Apple App Store or Google Play.
Eligibility, availability, payment timing, withholdings, reviews, blocks, rejections, required information and conditions applicable to payouts may depend on Stripe, the connected company, tax requirements, anti-fraud controls, legal obligations or TravelDesk's internal review.
TravelDesk does not store full bank card numbers within TravelDesk Connect. Payment or payout data may be processed by external providers in accordance with their own terms, policies and regulatory requirements.
Commissions, amounts, attribution rules, adjustments, cancellations, disputes, taxes, withholdings or commercial conditions are determined in accordance with the applicable agreements between TravelDesk, the connected company, the partner or commission agent and the corresponding providers.
Intellectual property, license and restrictions
TravelDesk grants the user a limited, non-exclusive, non-transferable, revocable and conditional license to use the Service in accordance with these terms, the assigned role and applicable authorizations.
TravelDesk retains all rights to the platform, software, interfaces, brand, design, workflows, documentation, integrations, databases, code, processes, reports, methodologies and elements protected by intellectual property rights.
The user may not copy, modify, distribute, sell, sublicense, commercially exploit, reverse engineer, bypass security controls, automate unauthorized access, extract data in bulk, interfere with the operation of the Service or use the platform to compete improperly with TravelDesk.
The user remains responsible for the information, files, documents, images, commercial data or operational data they upload or manage. By entering them into the Service, the user grants TravelDesk the authorization necessary to process, store, display, transmit or use them strictly to operate the Service, provide support, comply with obligations, prevent fraud and maintain security.
Availability, support, changes and suspension
TravelDesk makes reasonable efforts to keep the Service available and operational, but does not guarantee continuous, error-free or uninterrupted availability. Maintenance, updates, technical incidents, third-party failures, regulatory changes or operational limitations may occur.
TravelDesk may modify, improve, suspend, limit or withdraw features when necessary for technical, commercial, security, legal compliance or fraud prevention reasons, changes in providers, or protection of users and connected companies.
TravelDesk may suspend or limit accounts, access or features if it detects non-compliance with these terms, false information, unauthorized use, risk of fraud, abuse, a commercial dispute, a legal requirement, missing documentation, eligibility issues, a security risk or instructions from a connected company with authority over the user.
Support may be provided by email, internal app channels, the web platform or other means enabled by TravelDesk. Response times may vary depending on priority, complexity, operational availability and the need for validation.
Data, privacy, security and account deletion
The processing of personal data is governed by TravelDesk's Privacy Notice published on the official website. The user must review that notice to learn about the categories of data processed, purposes, providers, rights, retention, transfers and contact methods.
TravelDesk may process contact data, identity data, documents, photos, tax information, commercial activity, reservations, commissions, notification tokens, device data, Stripe Connect statuses, support data and other data necessary to operate the Service.
The user may request access, rectification, cancellation, objection, restriction of use or account deletion through the available support channels or by writing to support@traveldesk.mx. TravelDesk may require identity validation before processing a request.
Some requests may be subject to exceptions relating to legal, tax, accounting, contractual, regulatory, payment, payout, commission, fraud prevention, security, audit or dispute resolution matters. In those cases, TravelDesk may retain the necessary information for the required period.
The user acknowledges that deleting an account may affect access to reservations, commissions, reports, histories, pending payments, payouts, documentation, support or relationships with connected companies.
Liability, applicable law, amendments and contact
The Service is provided subject to its availability and the conditions permitted by applicable law. To the extent permitted by the relevant regulations, TravelDesk will not be liable for indirect damages, loss of income, loss of data, interruptions, third-party decisions, changes in providers, payout rejections, commercial disputes between users or connected companies, or misuse of the Service by the user.
The user agrees to hold TravelDesk harmless from claims arising from false information, unauthorized use, non-compliance with these terms, violation of third-party rights, fraudulent use, disputes with customers, connected companies, partners, commission agents or authorities, except where otherwise provided by law.
TravelDesk may update these Terms of Use to reflect changes in legal, technical, commercial, operational or security matters, providers, integrations or features. When changes are relevant, TravelDesk may publish them on its website, platform, app or official channels.
These terms will be interpreted in accordance with the laws applicable in Mexico, without prejudice to any non-waivable rights that may apply to users in other jurisdictions. For questions, support or requests relating to these terms, the user may contact TravelDesk at support@traveldesk.mx.
